4. (1) Notwithstanding the provisions of the Criminal Code or of any other law, a whistleblower who makes a protected disclosure is not liable to any civil or criminal proceedings or to a disciplinary proceeding for having made such a disclosure.

5. 5. (1) Subject to the provisions of the proviso to sub-article (2), and to the provisions of sub-articles (3) and (4), nothing in this Part shall prevent the institution of criminal proceedings against the whistleblower where the said whistleblower was the perpetrator or an accomplice in an improper practice which constitutes a crime or contravention under any applicable law prior to its disclosure.
